Terms of Service

Effective date: [Effective Date]

1. Acceptance & eligibility

These Terms of Service ("Terms") are a legal agreement between you and [Legal Entity Name] ("Dubby", "we", "us", or "our"). By creating an account, purchasing a subscription or license, or using the service, you agree to these Terms. You must be at least 16 years old and able to form a binding contract to use the service.

2. Description of service

Dubby is a self-hosted media server that you install and run on your own hardware. We sell a subscription/license and provide AI-assisted features, and plan to offer additional optional cloud features (such as Roam remote access and cloud backup) that you may choose to enable when they become available. You supply and control your own server and media. We do not host or provide your media.

3. Accounts & security

You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity under your account. Notify us promptly at [Contact Email] if you suspect unauthorized use.

4. Subscriptions, billing & cancellation

Paid plans are billed through Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis (monthly or annually, as selected) until you cancel. Subscriptions renew automatically at the end of each billing period. You can cancel at any time from your account settings; cancellation stops future renewals and takes effect at the end of your current billing period. Except where required by law, fees already paid are non-refundable. Refunds, if any, are provided at our discretion or as required by applicable law. We do not store your card numbers; Stripe stores your payment information.

5. License grant & server limits

Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Dubby software. Your subscription is per-account and permits activation on a limited number of server instances determined by your subscription tier. You may not exceed your tier's server limit, resell or sublicense your license keys, or circumvent activation or licensing controls.

6. Acceptable use

You are solely responsible for the legality of the content you store, stream, or otherwise handle through your own server. Dubby does not host, review, or monitor your media content. You must not use the service to infringe copyright or other intellectual property rights, or to store or distribute unlawful content. You must comply with all laws applicable to your use, and you must not misuse, disrupt, or attempt to gain unauthorized access to the service or its infrastructure.

7. Intellectual property

The Dubby name, logos, software, and related materials are owned by [Legal Entity Name] and its licensors and are protected by intellectual property laws. These Terms grant you no rights in our trademarks or branding. Your media library and content remain yours; we make no claim to it.

8. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any optional cloud feature will always be available.

9. Limitation of liability

To the maximum extent permitted by law, [Legal Entity Name] will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or relating to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless [Legal Entity Name] and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms or of any law or third-party right.

11. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. On termination, your license to use the software ends. Terms that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive termination.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, notify you. Continued use of the service after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of [Governing Law / Jurisdiction], without regard to its conflict-of-laws rules. Any disputes will be subject to the courts located in [Governing Law / Jurisdiction], unless otherwise required by applicable law.
